These Terms and Conditions govern your access to and use of https://wordpressbrain.com/, including any assessment, malware removal, hacked-site recovery, security, maintenance, monitoring, backup, blacklist removal, development, support, or related service provided by WP Brain.
In these Terms, “WP Brain,” “we,” “us,” and “our” refer to the operator of wordpressbrain.com. “Client,” “you,” and “your” refer to the person or organisation accessing the website, requesting an assessment, purchasing a service, or authorising us to work on a website or server.
By using our website, submitting an enquiry, approving a quotation, providing website access, making a payment, or instructing us to begin work, you agree to these Terms and Conditions.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our services.
When requesting work on behalf of a business, website owner, agency, client, or other organisation, you confirm that you have the authority to:
- Accept these Terms on its behalf;
- Provide us with access to the relevant website, hosting account, database, server, domain, or third-party platform;
- Authorise us to inspect and modify the relevant systems; and
- Approve payments and service instructions.
You must not ask us to access, inspect, modify, recover, or test any website or system that you do not own or have permission to manage.
2. Our Services
Depending on the service or plan selected, WP Brain may provide:
- WordPress malware detection and removal;
- Hacked website recovery;
- Malicious redirect removal;
- Backdoor, injected-code, shell, and rogue-user removal;
- Google or security-vendor blacklist removal assistance;
- Hosting suspension recovery assistance;
- WordPress error and white-screen troubleshooting;
- Security hardening;
- Website backup and restoration;
- WordPress core, theme, and plugin updates;
- Firewall and brute-force protection;
- Uptime, malware, and security monitoring;
- Website migration;
- Performance optimisation;
- Maintenance and technical support;
- Custom WordPress or WooCommerce development; and
- Other services agreed through a written quotation, email, invoice, support ticket, or WhatsApp conversation.
The exact scope, price, expected delivery time, number of websites covered, and included deliverables will be stated in the applicable service description, quotation, invoice, or written communication.
3. Free Assessments
A free assessment is a preliminary review intended to help identify visible or likely website issues.
A free assessment:
- May be limited to the information and access available to us;
- Is not a complete forensic or security audit unless expressly stated;
- Does not guarantee that every vulnerability, infection, backdoor, or configuration issue will be identified;
- Does not create an obligation for us to perform remediation work; and
- May require additional paid investigation before a complete diagnosis can be provided.
4. Quotations and Scope of Work
We may provide a fixed-price quotation or a customised quotation after reviewing the website and the reported issue.
A quotation is based on the information available at the time it is issued. Additional charges may apply when:
- The issue is materially different from what was originally reported;
- Multiple websites, subdomains, servers, or hosting accounts are affected;
- The website contains unusually large, complex, customised, or encrypted code;
- Additional development or restoration work is required;
- The hosting provider or third-party platform imposes additional requirements;
- The Client requests services outside the approved scope; or
- New issues are discovered that are unrelated to the original incident.
We will seek your approval before performing material work outside the agreed scope.
Unless otherwise stated, a quotation is valid for 15 days.
5. Website and Hosting Access
To perform our services, you may be required to provide temporary access to:
- WordPress administrator accounts;
- Hosting control panels;
- FTP, SFTP, or SSH accounts;
- Website files and databases;
- Domain or DNS settings;
- CDN, firewall, email, analytics, or security platforms; and
- Other relevant third-party services.
You authorise WP Brain to use the access provided solely for diagnosing, securing, restoring, maintaining, or otherwise performing the agreed services.
Where possible, you should create temporary accounts for us and revoke or delete them after the service has been completed.
We may reset passwords, remove unknown users, disable compromised plugins, modify files, update software, change permissions, edit databases, configure security settings, or temporarily restrict website access when reasonably necessary to perform the service.
Where practical, we will inform you before taking an action that is expected to cause material website downtime. In an active security emergency, immediate action may be required to prevent further damage.
6. Client Responsibilities
You agree to:
- Provide accurate information about the website and reported problem;
- Provide complete and working access credentials without unreasonable delay;
- Inform us about custom code, integrations, licences, server restrictions, and previous security incidents;
- Maintain valid licences for all commercial themes, plugins, software, and services;
- Avoid making conflicting changes while our work is in progress;
- Keep your contact and billing information current;
- Review and test the website after completion;
- Change or revoke access credentials after the work is finished;
- Follow reasonable security recommendations provided by us; and
- Comply with all applicable laws and third-party terms.
You remain responsible for the website’s content, business operations, legal compliance, user data, product information, transactions, and relationships with your customers.
Delays caused by missing access, inaccurate information, hosting restrictions, Client changes, or third-party providers may extend the estimated completion time.
7. Backups and Data
Where included in the service, we will make commercially reasonable efforts to create a backup before making material changes.
However, you remain responsible for maintaining your own current and independently stored backups. You should not rely exclusively on any backup created or retained by WP Brain.
We cannot guarantee that a backup will be complete, usable, or restorable when:
- The website or database was already corrupted;
- The hosting account lacks sufficient storage or functionality;
- Files or records had already been deleted;
- The server is inaccessible or suspended;
- The hosting provider restricts backup access;
- Encryption, malware, or server failure affects the data; or
- Circumstances outside our reasonable control prevent a complete backup.
We may delete working copies and temporary backups after the service or support period has ended, unless a longer retention period is agreed in writing.
8. Service Timeframes
Any response time, same-day recovery statement, completion estimate, or delivery date is a good-faith target and not an absolute guarantee.
Completion time may depend on:
- The type and extent of the infection;
- Website and database size;
- Hosting or server performance;
- Availability of valid backups;
- Access provided by the Client;
- Third-party response times;
- Blacklist or reconsideration procedures;
- Customised or outdated software; and
- New issues discovered during the work.
“24/7 support” means that emergency requests may be submitted at any time. It does not guarantee immediate resolution or continuous work on every request.
9. Payments, Taxes and Invoices
Fees will be stated on the website, quotation, invoice, checkout page, or other written communication.
Depending on the agreed service, payment may be required:
- Before work begins;
- In instalments;
- Upon completion of an agreed milestone; or
- After the website has been substantially recovered.
Applicable taxes, including GST, will be stated in the quotation or invoice where required.
You agree to pay approved invoices by the due date using an accepted payment method. Bank, card, currency-conversion, gateway, or international transfer fees may be payable by the Client.
WP Brain may suspend or withhold deliverables, ongoing monitoring, support, or access to paid services when an undisputed payment is overdue.
10. No Fix, No Fee
The “No Fix, No Fee” promise applies only when it is expressly included in the relevant service description or written quotation.
For this purpose, a “fix” means that WP Brain has substantially completed the agreed recovery objective, such as removing the identified malware and restoring the website to a reasonably accessible or operational condition.
The promise does not apply when:
- You cancel the service after work has started;
- You fail to provide the required access or cooperation;
- The hosting account, domain, server, or third-party service is unavailable;
- The website cannot be restored because required files, data, licences, or backups do not exist;
- You reject a reasonable technical solution;
- Work has been substantially completed but an unrelated issue remains;
- The website is reinfected due to changes made after our work;
- A third party reverses, alters, or interferes with our work; or
- Recovery is prevented by circumstances outside our reasonable control.
Any unavoidable third-party, licence, hosting, domain, software, or infrastructure charges remain payable unless expressly waived.
11. Refund and Cancellation Policy
One-Time Services
Once work has started, fees for assessments, malware removal, recovery, development, migration, optimisation, or other one-time services are generally non-refundable, except where:
- The service is expressly covered by the No Fix, No Fee promise;
- We are unable to provide a material part of the agreed service;
- A refund is expressly approved by us in writing; or
- A refund is required under applicable law.
Protection and Maintenance Plans
Annual or recurring plans may be cancelled by notifying us before the next renewal.
Unless otherwise stated in the applicable quotation or required by law:
- Cancellation does not result in a prorated refund for an active period;
- Services will continue until the end of the paid term;
- A plan will not renew unless the required renewal payment or authorisation is received; and
- Any work requested after the paid term may be charged separately.
Duplicate or clearly erroneous payments will be refunded after verification.
Approved refunds will normally be returned through the original payment method or another mutually agreed method. Banking or payment-processing time is outside our control.
12. Thirty-Day Reinfection Guarantee
Where expressly included, the 30-day reinfection guarantee begins on the date we confirm completion of the malware-removal service.
If the same website is reinfected during that period due to the same unresolved entry point or the same infection that we were engaged to remove, we will perform another clean-up without charging an additional clean-up fee.
The guarantee does not cover reinfection or damage caused by:
- New vulnerabilities discovered after completion;
- Outdated software that you decline or fail to update;
- Compromised passwords, devices, email accounts, or administrator accounts;
- Insecure hosting, shared-server infection, or hosting-provider failure;
- Unlicensed, nulled, pirated, abandoned, or modified software;
- New plugins, themes, code, users, or integrations added after completion;
- Changes made by the Client or another developer;
- Failure to follow our security recommendations;
- Phishing, social engineering, denial-of-service attacks, or credential theft;
- A different website, subdomain, application, or server not included in the original scope;
- Continued access by an unauthorised third party; or
- Matters outside our reasonable control.
The guarantee provides a repeat clean-up service. It does not provide compensation for lost revenue, traffic, data, reputation, advertising costs, customer claims, or other losses.
13. Annual Protection Plans
Protection plans apply only to the website, domain, or installation identified in the applicable order or quotation.
Unless otherwise stated:
- One plan covers one WordPress installation;
- Monitoring frequency refers to the scheduled frequency stated in the selected plan;
- Automated monitoring may rely on third-party tools;
- Support is subject to reasonable use;
- Development, redesign, content entry, SEO, advertising, hosting, and unrelated technical work are not included;
- Premium plugin, theme, hosting, domain, CDN, or third-party licence fees are not included; and
- Unused services or support time do not carry forward after the plan ends.
References to “real-time” monitoring mean automated or commercially reasonable continuous monitoring where supported by the relevant technology. They do not mean that a person is manually watching the website every second.
A “dedicated security engineer” means a designated technical contact or engineer assigned to manage eligible security matters. It does not mean an employee working exclusively or full-time for one Client.
14. Unlimited Clean-Ups and Fair Use
Where a plan includes “unlimited clean-ups,” this applies to reasonable malware clean-up requests affecting the covered website during the active subscription period.
It does not cover:
- Multiple websites or installations;
- Repeated infections caused by ignored recommendations;
- Deliberate installation of unsafe or unlicensed software;
- Development, rebuilding, redesign, or content restoration;
- Server-wide incidents outside the covered website;
- Abuse of the service; or
- Incidents resulting from illegal, deceptive, or prohibited activity.
We may require an upgraded or separately priced service where usage is excessive, technically unreasonable, or outside the intended scope of the plan.
15. Blacklist and Hosting Reinstatement Services
We may assist with reconsideration, delisting, malware review, or hosting-reinstatement requests submitted to Google, hosting providers, browsers, antivirus companies, search engines, or other security vendors.
These third parties make their own decisions and control their own review timelines.
We do not guarantee:
- That a blacklist warning will be removed;
- That a hosting account will be reinstated;
- That search rankings or traffic will be restored;
- That indexed spam pages will be removed by a specific date; or
- That a third party will accept our request or evidence.
Our obligation is limited to performing the agreed remediation and submitting or assisting with reasonable review requests.
16. Third-Party Products and Services
Our work may involve WordPress, hosting companies, domain registrars, plugins, themes, payment gateways, security platforms, CDNs, email providers, analytics tools, or other third-party services.
We do not own or control these services and are not responsible for:
- Their availability, performance, security, pricing, or policies;
- Changes or updates made by their providers;
- Compatibility issues caused by third-party software;
- Licence expiry or account suspension;
- Data loss or service interruption caused by them; or
- Their decision to reject, delay, suspend, or terminate a service.
You remain responsible for complying with third-party terms and maintaining the necessary accounts and licences.
17. Security Limitations
We use commercially reasonable methods to diagnose, clean, secure, and monitor websites. However, no website, hosting environment, firewall, security tool, or monitoring system can be guaranteed to be completely secure or permanently free from malware.
Cybersecurity threats, software vulnerabilities, attack techniques, and third-party systems continually change. Therefore, we do not guarantee that:
- A website will never be attacked or compromised again;
- Every vulnerability or malicious file will always be detected;
- Monitoring will prevent every incident;
- A website will remain continuously available;
- No data will ever be lost; or
- Security measures will be effective against every present or future threat.
Ongoing updates, secure passwords, access control, reliable hosting, licensed software, backups, and responsible website management remain essential.
18. Confidentiality and Credentials
We will use reasonable care to protect confidential information and access credentials provided to us.
We will use such information only for providing the agreed services, administering the Client relationship, complying with legal obligations, or protecting our legitimate interests.
We may share limited information with employees, contractors, hosting providers, security tools, or other service providers where reasonably necessary to perform the service, subject to appropriate confidentiality or data-protection obligations.
You should avoid sending permanent passwords through unsecured channels and should change temporary credentials after completion.
Our collection and use of personal information are also governed by our Privacy Policy.
19. Intellectual Property
WP Brain retains ownership of:
- Its website content, branding, processes, checklists, reports, templates, scripts, tools, methodologies, and documentation;
- Pre-existing code and reusable components;
- Internal security procedures and technical know-how; and
- Materials not specifically created and transferred to the Client.
The Client retains ownership of its website content, branding, business data, and materials supplied to us.
For custom development, ownership and licence terms will be stated in the applicable quotation. Unless otherwise agreed, the Client receives a non-exclusive licence to use custom deliverables after full payment.
No ownership is transferred in WordPress, open-source software, third-party code, plugins, themes, fonts, images, or other licensed materials. Such materials remain subject to their respective licences.
20. Acceptable Use
You must not use our website or services to:
- Access or interfere with systems without authorisation;
- Distribute malware, phishing content, spam, or malicious code;
- Operate an illegal, fraudulent, deceptive, or abusive website;
- Infringe intellectual property, privacy, or other legal rights;
- Harass, threaten, impersonate, or harm another person;
- Circumvent security controls;
- Misrepresent your ownership or authority over a website;
- Request concealment of illegal activity; or
- Violate any applicable law or regulation.
We may refuse, suspend, or terminate services where we reasonably believe that the request is unauthorised, illegal, unsafe, deceptive, or harmful.
21. Suspension and Termination
Either party may terminate a service as permitted by the applicable quotation or plan.
We may immediately suspend or terminate work when:
- Payment is overdue;
- Required access or cooperation is not provided;
- You breach these Terms;
- Continuing the work may create a legal or security risk;
- The website contains unlawful or seriously harmful material;
- You abuse or threaten our team;
- You interfere with work in progress; or
- A third-party restriction makes continued performance impractical.
Upon termination, you must pay for completed work, approved expenses, and committed third-party costs, except where the No Fix, No Fee promise expressly applies.
22. Disclaimer of Warranties
Except for an express written guarantee included with a specific service, our website, assessments, recommendations, and services are provided on an “as available” and commercially reasonable basis.
To the maximum extent permitted by law, we disclaim implied warranties relating to uninterrupted availability, merchantability, fitness for a particular purpose, non-infringement, search-engine performance, revenue, traffic, sales, or business results.
Website testimonials, statistics, past recovery results, and examples describe previous experiences and do not guarantee that every Client will receive the same result.
23. Limitation of Liability
To the maximum extent permitted by applicable law, WP Brain will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential loss, including loss of:
- Revenue, profit, customers, contracts, or business opportunity;
- Website traffic, search rankings, or advertising spend;
- Data, content, files, emails, or records;
- Reputation, goodwill, or customer trust; or
- Use or availability of a website or service.
Our total aggregate liability arising from a particular service will not exceed the amount actually paid to WP Brain for that service during the six months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
24. Indemnification
You agree to indemnify and hold harmless WP Brain, its owners, employees, contractors, and representatives from third-party claims, liabilities, damages, costs, and reasonable legal expenses arising from:
- Your website content, products, services, or business operations;
- Your breach of these Terms;
- Your violation of applicable law or third-party rights;
- Your lack of authority to provide access to a website or system;
- Unlicensed or unlawful software or content supplied by you; or
- Instructions given by you that cause harm to another person or organisation.
25. Force Majeure
We will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including:
- Internet or telecommunications failure;
- Hosting, cloud, DNS, domain, or data-centre outages;
- Cyberattacks or newly discovered vulnerabilities;
- Government action or legal restrictions;
- Natural disasters, fire, flood, epidemic, or war;
- Power failure;
- Labour disruption; or
- Failure of a third-party service provider.
We will make reasonable efforts to resume the affected service when circumstances permit.
26. WordPress and Third-Party Trademarks
WordPress and related trademarks belong to their respective owners.
WP Brain is an independent WordPress support, security, recovery, and development service. Unless expressly stated, we are not affiliated with, endorsed by, or sponsored by Automattic Inc., the WordPress Foundation, WordPress.org, Google, any hosting provider, or any security vendor.
Third-party names, logos, and trademarks displayed on the website remain the property of their respective owners.
27. Governing Law and Disputes
These Terms are governed by the laws of India.
The parties will first attempt to resolve any dispute through good-faith written communication.
If a dispute cannot be resolved amicably, it will be subject to the exclusive jurisdiction of the competent courts located where WP Brain’s principal business office is situated, unless applicable consumer law requires otherwise.
28. Changes to These Terms
We may update these Terms to reflect changes in our services, pricing, business practices, technology, or legal obligations.
The updated version will be published on this page with a revised “Last Updated” date. Changes will apply from the date of publication and will not retrospectively reduce rights already confirmed under a paid service unless permitted by law.
Your continued use of the website or services after an update constitutes acceptance of the revised Terms.
29. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A failure or delay by WP Brain in enforcing a right does not waive that right.
30. Entire Agreement
These Terms, together with the applicable quotation, invoice, service description, Privacy Policy, and written scope of work, constitute the agreement between you and WP Brain.
Where there is a conflict, the following order of priority will apply:
- A separately signed written agreement;
- The approved quotation or scope of work;
- The applicable invoice or service-plan description;
- These Terms and Conditions; and
- General website content.
